Section 301 of the Trade Act of 1974 lets the US Trade Representative investigate a foreign country's trade practices and, if found unfair, impose tariffs or other retaliatory measures without congressional approval. It's the tool the Trump administration has repeatedly used to open tariff fights with China and other trading partners, so launching an investigation is itself read as a signal that tariffs may follow.
